Country Club Blvd city: Stockton zip code: 95204 Address Product owner or Operator: Ahmed Muthanna, Owner: Fahmi Alsumeri Telephone: 209 303-3783 Operator: Type of significant violation: ❑ A violation that is causing, or threatens to cause a liquid release of petroleum from an underground storage tank system, including, but not limited to: the failure of any required overfill prevention system, where the failure is causing or threatens to cause a release; or the failure of a required spill containment structure, where the failure is causing or threatens to cause a release to the environment due to a spill or an overfill. ❑ A violation that impairs the ability of an underground storage tank system to detect a liquid leak or contain a liquid release of petroleum in the manner required by law. Z A chronic violation or a violation that is committed by a recalcitrant violator. In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including corrective action). On 12/30/2020, Vicky Vang-Lee of San Joaquin County Environmental Health Department (EHD) performed a routine underground storage tank (UST) inspection at the above referenced site. The site was found to be out of compliance. The violations include but are not limited to the following: -At the time of the inspection, Ahmed Muthanna stated that he has been the new operator for the site for approximately 11 months. A permit to operate has not been issued. No person may own or operate an UST unless a permit for it's operation has been issued by the local agency to the owner or operator of the UST system. (HSC 25284) -The change of operator has not been reported to the California Environmental Reporting System (CERS). The owner or operator shall submit changes to the CERS within 30 days along with all applicable submittal elements for the permit application. (CCR 2711) -The overfill prevention inspection has not been conducted. Overfill prevention equipment must be inspected by 10/13/2018 and every 36 months thereafter. (CCR 2637.2) The site must be brought into compliance to avoid the entire UST system being red tagged 7 -days from the receipt of this Notice.
