In determining whether a violation is <br />chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br />violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br />corrective action). <br />On 12/30/2020, Vicky Vang-Lee of San Joaquin County Environmental Health Department (EHD) performed a routine underground <br />storage tank (UST) inspection at the above referenced site. The site was found to be out of compliance. The violations include but <br />are not limited to the following: <br />-At the time of the inspection, Ahmed Muthanna stated that he has been the new operator for the site for approximately 11 <br />months. A permit to operate has not been issued. No person may own or operate an UST unless a permit for it's operation has <br />been issued by the local agency to the owner or operator of the UST system. (HSC 25284) <br />-The change of operator has not been reported to the California Environmental Reporting System (CERS). The owner or operator <br />shall submit changes to the CERS within 30 days along with all applicable submittal elements for the permit application. (CCR 2711) <br />-The overfill prevention inspection has not been conducted. Overfill prevention equipment must be inspected by 10/13/2018 and <br />every 36 months thereafter.
