In determining whether a violation is <br />chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br />violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br />corrective action). <br />On 03/10/2021, Vicky Vang-Lee of San Joaquin County Environmental Health Department (EHD) issued a <br />Notice of Significant Violation to Ahmed Muthanna at the above referenced site. The site was given 7 <br />days from receipt of the notice to comply or the entire UST system would be red tagged. The site <br />continues to be out of compliance for the following: <br />The overfill prevention inspection has not been conducted. Overfill prevention equipment must be <br />inspected by 10/13/2018 and every 36 months thereafter. (CCR 2637.2) <br />No person shall remove, deface, alter, or otherwise tamper with a red tag so that the information contained <br />on the tag is not legible. No owner/operator of a facility may deposit or allow the deposit of petroleum into, <br />and no person shall withdraw from, except to empty, a UST system that has a red tag affixed to the <br />system's fill pipe.
