Complaint Investigation Summary Report#:5105
COMPLAINT ID: COYCVDBFQ Site Location: 1074 ACADEMY ST
Activity Summary
Activity Date Recorded by
08/03/2020 Emailed Mike Algots, Union Pacific Railroad Hazmat Manager, the spill FLORIDO
information and requested he determine if the spill is on Union Pacific's Property.
Mike stated Union Pacific's right of way is 40 feet(a generous estimate, according
to Mike) from the middle of the tracks, and the latitute/longitude coordinates I
provided him for the spill are out of UPR's right of way. Mike stated to let him know
if we go out to the site and determine the spill is actually on UPR's right of way.
08/03/2020 Discussed complaint further with Elena and Muniappa Naidu, CUPA PC. It was FLORIDO
determined that I will go out to the site and measure the distance of the spill from
the middle of Academy St. If the spill is more than 30 ft from the middle of the
street, the property owner is responsible for the spill.
08/04/2020 Completed and submitted overtime slip and EC print out to Muniappa Naidu, FLORIDO
CUPA PC.
08/05/2020 Date stamped and downloaded photos. FLORIDO
Arrived on site and measured the distance of spill from the center of Academy St
and from the center of Union Pacific Railroad's (UPRR) track. The spill is 37 feet
from the center of Academy St, and 60 feet from the center of UPRR's track.
Since SJC's right-of-way is 30 feet from the center of Academy St, and UPRR's
right-of-way is 40 feet from the center of the track, the spill is located on the
property of 1074 E Academy St and is the responsibility of the property owner. Left
a voice message and sent a text message to the complainant, stating that I will be
mailing a notification letter to the property owner regarding the abandoned spill.
Received several text messages back from complainant indicating the spill may
still be the responsibility of the County or UPRR. I told complainant to contact
either SJC Community Development Dept or the Assessor's Office, if complainant
believes the right-of-ways are incorrect. Complainant requested the name and
mailing address to which I will send the notification letter. I told complainant I will
have it tomorrow when I am back in the office, however I don't believe I am
allowed to provide her with the property owner information.
08/12/2020 Discussion with Muniappa Naidu, CUPA Program Coordinator, regarding letter to FLORIDO
be sent to the property owner.
Generated letter to inform the property owner of the abandoned oil spill/stain and
how to clean up/dispose of the material properly. Provided letter, list of clean-up
contractors, and a SJC Household Hazardous Waste brochure to office assistants
to mail certified to the property owner.
08/13/2020 Mailed complaint cover letter dated 08-12-20 with Household Hazardous Waste MARTINEZ
Disposal Guide & Hazardous Waste Clean-Up Company print out by certified mail
to:
WOODBRIDGE GUILD CORP,
PO BOX 1584,
WOODBRIDGE CA 95258-1584.
Certified mail#7018 1830 0001 6176 7451.
08/20/2020 Emailed complainant a copy of City of Stockton's list of hazardous materials FLORIDO
clean-up companies.
08/28/2020 Certified mail return. Was returned as NOT DELIVERABLE AS ADDRESSED BLACKWELL
UNABLE TO FORWARD. Certified mail#7018 1830 0001 6176 7451. Gave to
Inspector Florido.
09/09/2020 Reviewed/revised narrative, per Accounting (MO). FLORIDO
5105.rpt Page 2 of 3
