City retained Patriot <br /> Environmental to address the storm drain impact. All residual contamination must be addressed, all generated <br /> waste must be disposed of under the appropriate waste manifesting procedure [HSC 25160 (b)(3)]. The <br /> disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal is at a facility which is <br /> not permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a).] Make a hazardous waste <br /> determination [CCR. 66262.11]for the generated waste material, dispose of all waste as appropriate, and <br /> provide disposal records to the EHD for all clean up material as soon as they become available. <br /> VIOLATIONS: <br /> M Discharge of any Waste, including Sewage <br /> (CA Health and Safety Code 5411) <br /> ® Discharge of Waste or Sewage to Water or within 150' of Waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> ® Improper Disposal of a Hazardous Waste <br /> (CA Health and Safety Code 25189.5) <br /> ❑ Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> ❑ Other: <br /> CORRECTIVE ACTIONS/ORDER: <br /> Immediately contain, clean up, and dispose of the waste at an authorized, permitted location. <br /> Ensure that clean up personnel possess adequate training. <br /> IN Investigate and abate contamination under the oversight of the appropriate lead agency. <br /> ® Submit copies of hazardous waste manifests/disposal records to the EHD within 30 days. <br /> L Other: dispose of waste and provide disposal info to EHD Correct By: as soon as feasible <br /> COST RECOVERY:All EHD Staff Time Associated with this Spill Response is Billed to the Responsible Party at <br /> the Current Hourly Rate.
