Contacted Ancon Services to perform clean-up. <br /> I observed three 55-gallon drums half filled with absorbent contaminated with mineral oil. <br /> Please be advised that the disposal of any waste[HSC 5411]or disposal of any hazardous waste, or the causing thereof, is <br /> prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. <br /> [HSC25189.5(a).]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste shall <br /> be disposed of under appropriate hazardous waste manifesting procedure[HSC 25160(b)(3)]. Provide a copy of the waste <br /> sample analytical results prior to disposal of the waste, and the waste/hazardous waste disposal records to the EHD for all <br /> clean up debris associated with this spill clean-up. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> El Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> CORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> IMMEDIATELY. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> For the three 55-gallon drums with absorbent contaminated with mineral oil and any additional waste generated during <br /> clean-up, please manage according to Title 22 California Code of Regulations for hazardous waste.
