Half of a gallon <br /> from the release spilled onto the pavement below the shipping container. <br /> OBSERVATIONS: <br /> The release was caused by a hairline crack in a 55 gallon drum. The chemical spilled onto the floor of the shipping <br /> container and onto the pavement below it. The spill was cleaned up by Patriot Environmental to EHD standards. <br /> Approximately 1/5 of a 55 gallon drum was filled with used absorbent. Derek Smith, manager with Patriot Environmental, <br /> revised the spill amount to approximately 2 gallons. It is currently unknown how the waste is going to be disposed of. <br /> Samples of the waste were taken by Patriot Environmental to run for a hazardous waste determination. <br /> The notice to abate was emailed on 6/30/2020 to Mark Bunte R+L Carriers at<mark.bunte rlcarriers.com>. <br /> VIOLATIONS: <br /> Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Immediately. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Per Title 22 California Code of Regulations(CCR)66262.11, any person who generates a waste shall determine if the <br /> waste is a hazardous waste.There are wastes that are listed as hazardous wastes. There are wastes that exhibit one <br /> or more of the hazardous waste characteristics:toxic, corrosive, reactive or ignitable. <br /> Immediately make a hazardous waste determination for the waste, and manage it according to Title 22 CCR. Use <br /> Safety Data Sheets(SDS),waste sampling and test results or other knowledge to support your hazardous waste <br /> determination. Waste testing must be done using methods specified in Title 22 CCR, including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination.
