SAN J U A Q U I N Environmental Health Department <br /> WASTE DISCHARGE/SPILL RESPONSE <br /> NOTICE TO ABATE <br /> Responsible Party: CALTRANS/SOLID WASTE DIVISION Date: Jul 01, 2020 <br /> RP Mailing Address: 1604 SOUTH B STREET/1810 E HAZELTON Record ID#: C00052167 <br /> STOCKTON/STOCKTON, CA/CA 95206- Program Element: 2546 <br /> Spill Location: 0 E HWY 26, LINDEN Release/Spill Response(excluding Joint Team) <br /> NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br /> Approximately 70 gallons of diesel released onto soil due to traffic accident. <br /> OBSERVATIONS: <br /> On 06-30-2020, diesel was observed on the soil under a Solid Waste Division truck's punctured fuel tank resulting from <br /> collision with another vehicle. On the opposite side of the road,there was dark oily staining in the soil released from the <br /> second vehicle involved in the accident.All Environmental Services was onsite and determined a USA dig notification was <br /> needed for the removal of the contaminated soil. Sites were coned off and pending excavation scheduling. Please be aware <br /> that all impacted soil has to be excavated and disposed of under the appropriate waste manifesting procedure[HSC 25160 <br /> (b)(3)].The disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal is at a facility which is <br /> not permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a).] Notify EHD (48-hours) in advance of any <br /> cleanup activities. Provide disposal records for all generated wastes. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Immediately. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Other Correction <br /> EHD 25-01 Rev.08/17/17 page 1 of 2 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br /> 1868 E.
