SPILL IS CONTAINED. LATHROP POLICE DEPARTMENT <br /> AND LATHROP PUBLIC WORKS WERE ON SCENE. <br /> OBSERVATIONS: <br /> After speaking to Josh Jones of Lathrop Manteca Fire, Lathrop Manteca Battalion Chief Josh Caper, Lathrop Police Deputy <br /> Aaron Silva, and Lathrop Public Works on-call responder Ian, I received the following information:The spill occurred on <br /> 9/7/20 at 10:30 pm on Harlan Rd near the southwest corner of Harlan Rd and Lathrop Rd, from a vehicle accident that <br /> caused 20 gallons of diesel,from a 50 gallon reefer trailer rented by Penske,to spill onto the roadway and gutter; no impact <br /> to soil or drains; and Patriot Environmental pumped the remaining diesel from the fuel tank and conducted the spill clean-up. <br /> Arrived on-site and observed diesel and absorbent staining on northbound Harlan Rd just south of Lathrop Rd, in the <br /> roadway and gutter. The spill did not appear to have reached any drains.The spill clean-up appeared complete. <br /> Spoke to Lupe Baez of Patriot,who conducted the spill clean-up on behalf of Penske. Lupe provided me with photos of the <br /> spill clean-up and generator hazardous waste manifest.Two 55 gallon drums of diesel contaminated solids was transported <br /> off-site as non-RCRA hazardous waste. Lupe stated he did not pump out the 1-2 gallons of diesel that remained in the <br /> reefer trailer fuel tank, rather the tow truck company placed absorbent in the fuel tank and transported it to the Penske yard <br /> either in Stockton or Lathrop. <br /> Be advised that the disposal of any waste[HSC 5411]or disposal of any hazardous waste, or the causing thereof, is <br /> prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC <br /> 25189.5(a).]. Be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting <br /> procedure[HSC 25160(b)(3)]. Provide a copy of the waste sample analytical results prior to backfilling any excavation and <br /> prior to disposal of the waste, and the waste/hazardous waste disposal records to the EHD for all clean up debris associated <br /> with this spill clean-up. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> • Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> kORRECTIVE ACTIONS/ORDER: <br /> EHD 25-01 Rev.8/18/2020 Page 1 of 2 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br /> 1868 E.
