SAN 10 A Q U I N Environmental Health Department <br /> —COUNTY- <br /> WASTE DISCHARGE/SPILL RESPONSE <br /> NOTICE TO ABATE <br /> Responsible Party: UNION PACIFIC RAILROAD CO Date: Aug 21, 2020 <br /> RP Mailing Address: 1600 VERNON ST Record ID#: CODMUHF00 <br /> ROSEVILLE, CA 95678- Program Element: 2546 <br /> Spill Location: 833 E 8TH ST, STOCKTON Release/Spill Response(excluding Joint Team) <br /> NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br /> Locomotive UP9923 was overfilled causing the release of 100 gallons of diesel fuel onto soil and the surrounding tracks. <br /> OBSERVATIONS: <br /> Diesel fuel released onto soil on both sides of the locomotive creating a stained area of approximately 20x30 feet. Union <br /> Pacific hired Patriot Environment to clean the spill. The site is currently in the process of having a dig ticket cleared to begin <br /> cleanup. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> El Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Immediately. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Submit final disposal records and analytical results to the EHD. <br /> Other Correction <br /> COST RECOVERY: All EHD time associated with this Spill Response is billed to the responsible party at the current hourly <br /> rate.
