Environmental Health Department <br /> N..-.JO <br /> --COUNTY- <br /> WASTE DISCHARGE/SPILL RESPONSE <br /> NOTICE TO ABATE <br /> Responsible Party: LOUP LOGISTICS Date: Aug 25, 2019 <br /> RP Mailing Address: 1400 DOUGLAS STREET Record ID#: CON07DK5W <br /> Omaha, NE 68179- Program Element: 2546 <br /> Spill Location: 1000 E ROTH RD, FRENCH CAMP Release/Spill Response(excluding Joint Team) <br /> NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br /> Two releases occurred with the same responsible parry. Release 1: Approximately 2-3 gallons of a salt brine released out <br /> of a 55 gallon drum located in car EMHU 200166. The release could also be seen on the container below it(EMHU 206014). <br /> Release 2: Approximately 1 gallon of battery acid and 2-3 gallons of a hydraulic oil were released from several containers <br /> located in car EMHU 263361. The release sprayed onto the side of another container(EMHU 249268). <br /> OBSERVATIONS: <br /> Arrived on site and met with Joe McGuffin, Patriot Environmental Supervisor. Patriot Environmental(Patriot) had been hired <br /> by the responsible party to clean up the releases. Regarding release 1 where white crystals were observed in car EMHU <br /> 200166: Patriot Environmental searched through the entire car containing white crystals and found the source of the release <br /> to be a salt water brine from a 55 gallon drum containing sausage casings. The car also contained peroxides. According to <br /> Patriot, all of the peroxide containers were intact with no signs of a release. The crystals that were observed from the brine <br /> release were wiped up using cloths including any material that was observed on the car below it(EMHU 206014). One 10 <br /> gallon plastic bag of wipes was generated. The waste is going to be disposed of as non-hazardous and thrown away at the <br /> Patriot Environmental Yard. When I arrived on site,the cleanup had been completed and no signs of the release was <br /> observed. Regarding release 2 with the battery acid and the hydraulic oil: The cleanup is currently in progress by Patriot. <br /> Oily staining was observed on the side of car EMHU 249268. Oily staining was also observed on the underside of the car <br /> containing the released material(EMHU 263361). According to Derek Smith, Field Supervisor, no fluid was observed <br /> around the battery. Only one gallon of hydraulic oil appeared to be released from this incident. It is unknown how the waste <br /> will be disposed of as. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> CORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Immediately. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Submit the final disposal records to the EHD. Make a complete hazardous waste determination for every waste <br /> generated including: the salt water brine solution, the oil, and the battery acid.
