Record ID#: COUEZKMF6 <br /> STOCKTON, CA 95219- Program Element: 2546 <br /> Spill Location: 11530 W EIGHT MILE RD, STOCKTON Release/Spill Response(excluding Joint Team) <br /> NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br /> SUNKEN 37 FOOT VESSEL RELEASING APPROXIMATELY 5 GALLONS OF OIL LOCATED AT EMPIRE DOCK SPACE <br /> 11. <br /> OBSERVATIONS: <br /> Met with CJ Spurlock, showed me the sunken vessel located at dock 11. Boons and absorbent pads were placed around the <br /> vessel to contain the oil.The vessel is actively releasing oil and oily sheen can be observed spreading out to the surround <br /> spaces(space 1-14). CJ states that approximately 20 gallons of oil could be in the vessel, he stated that the vessel had no <br /> diesel in the tank. <br /> All generated clean up wastes must be transported according to all applicable manifesting procedures(HSC25160(b)(3)) <br /> and disposed of according to all applicable Title 22 regulations. The disposal of any hazardous waste, or the causing <br /> thereof, is prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. <br /> HSC25189.5(a).1 <br /> VIOLATIONS: <br /> Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> • Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> El Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> IMMEDIATELY. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> For the approximately 5 gallons of oil released from the 37 foot sunken vessel and boons and absorbent pads used to <br /> contain the oil please manage the hazardous waste according to Title 22 California Code of Regulations for hazardous <br /> waste.
