OBSERVATION:An inspection was last done on 06/15/2020 and an inspection report was issued identifying information to be submitted to bring this site into compliance. This information was required to be submitted by 07/15/2020. This information has not been received resulting in a non-compliant status for this facility. REGULATION GUIDANCE:An operator that receives an inspection report shall have 30 days to implement the corrections specified in the inspection report and comply with permit conditions. The corrective action shall include all of the recommendations made in the report. The operator shall submit a written response that includes a statement documenting corrective actions taken or proposing corrective actions which will be taken. CORRECTIVE ACTION: Ensure that a written response documenting corrective actions taken or proposed is submitted and all corrections implemented within 30 days of receiving an inspection report. This is a repeat violation, Class II. 210 CCR 2715(c)Failure to provide initial training,train every 12 months, and have a trained employee present. OBSERVATION: The designated operator employee training for Krystal Ellis was not performed prior to Krystal assuming responsibility as a site employee. Per the 02/26/21 training certificate, Krystal's date of assuming responsibility was in February 2020 and her initial training date was 02/26/2021. REGULATION GUIDANCE: The designated operator shall train facility employees in the proper operation and maintenance of the UST system at least once every 12 months. The training shall be conducted before the individual performs the duties of a facility employees.The training shall include, but is not limited to: 1. Operation of the UST system in a manner consistent with the facility's best management practices 2. Employee's role with regard to monitoring equipment as specified in the facility's monitoring plan 3. Employee's role with regard to spills and overfills as specified in the facility's response plan 4. Name of the contact person(s)for emergencies and monitoring equipment alarms Initial training shall also include a site-specific practical demonstration that provides both sharing information and evaluating knowledge for responding to emergencies, leak detection, monitoring alarms, spills and overfills. At least one of the facility employees present during operating hours shall have current training. CORRECTIVE ACTION: Ensure that employees have been trained by the designated operator as required (before assuming responsibility and annually thereafter)and maintain the list on site.. This is a repeat violation, Class II. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by April 17, 2021 .
