5. The use is compatible with adjoining land uses. <br /> • This finding can be made because the proposed use may be conditionally permitted in the <br /> AG-40 zone with an approved Site Approval application.The proposed use will not interfere <br /> with nor alter the current land uses on adjoining properties. The adjacent surrounding <br /> parcels are primarily agricultural with scattered residences. <br /> Pursuant to the Telecommunications Act of 1996 and T-Mobile USA Inc.v.City of Anacortes, <br /> 572 F.3d 987, and a related line of cases, the County shall not deny an application for a <br /> wireless communication facility such as a cell tower if the applicant has shown that there is <br /> a significant gap in cellular coverage and that the proposed location is the least intrusive <br /> means to close that gap unless the County can show the"existence of a potentially available <br /> and technologically feasible alternative to the proposed location." Here, the Applicant has <br /> demonstrated a significant gap in cellular coverage for the community around the proposed <br /> tower and that the proposed tower is the least intrusive means to close that gap.The County <br /> has not found a feasible alternative site or technology to cover the gap. <br /> PA-2000214 (SA)— Findings 2 <br />
