Environmental Health Department <br />AMENDED <br />10/30/2019 <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Date: <br />October 24, 2019 <br /> Facility Address: <br /> 2475 Naglee Rd, Tracy <br /> Facility Name: <br /> ULTA BEAUTY #579 (Tracy) <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br />OBSERVATION: <br />A closed tub about half filled with a blue solution and labeled "Quatz/Barbercide," was observed next to a sink in <br />the Ulta Salon (see photo IMG 9035). According to Sarah Fellows, a Salon Stylist, the solution is used to disinfect <br />the hair tools used by the Salon employees, and is made according to the directions on the Barbicide container. <br />Barbicide, according to its container label, is a (liquid) germicide, psuedomonacide, fungicide, & virucide (IMG <br />9037). <br />The directions on the Barbicide container state: "To make a Hospital Disinfectant mix 2 ounces of Barbicide in 32 <br />ounces of water. Barbicide is for use in hospitals, heath care facilities, tanning facilities and in beauty salons, <br />barbershops, and hairstyling establishments...Beauty/Barber Instruments and Tools: Thoroughly clean brushes, <br />combs, clipper blades, shears, razors, and other inanimate hard surfaced non-porous tools and implements prior to <br />complete immersion for 10 minutes (or as required by local authorities) in a solution as prepared above. Rinse to <br />remove Barbicide after immersion and dry before used. Fresh solution must be prepared daily or more often if <br />solution becomes diluted or soiled" (IMG 9039). <br />According to Sarah, a tub of the Barbicide solution is made at the beginning of each day, and then the solution is <br />poured down the Salon sink at the end of each day. Sarah stated that if the solution becomes too dirty during the <br />day, the solution will be disposed of and a new batch of the solution will be made. <br />Beneath the sink was an empty tub labeled "Ship Shape" and a bag of Ship Shape Comb & Brush Cleaner powder <br />(IMG 9042, 9047, 9048). According to Sarah, a solution of Ship Shape is also made at the beginning of each day <br />and poured into the sink at the end of each day, however the Ship Shape solution had not been made at the time <br />of inspection. Sarah stated the Salon's hair tools are cleaned in the tub of Ship Shape solution, then disinfected in <br />the tub of Barbicide solution. <br />The Barbicide was labeled "Corrosive. Cause Irreversible Eye Damage And Skin Burns." and "Pesticide wastes are <br />acutely hazardous" (IMG 9038). Also, according to the Barbicide Concentrate Safety Data Sheet (SDS), Barbicide <br />Concentrate is a category 3 flammable liquid, under Occupational Safety and Health Administration (OSHA) <br />regulations. The Ship-Shape was labeled "Warning: Causes Skin Irritation" and "Causes Serious Eye Irritation" <br />(IMG 9042-3). <br />REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br />as specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous <br />wastes. There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive <br />or ignitable. <br />CORRECTIVE ACTION: Immediately stop disposal of the Barbicide and Ship Shape solutions down the drain, <br />make a hazardous waste determination for each waste , and manage it according to Title 22 CCR. Use Safety Data <br />Sheets (SDS), waste sampling and test results or other knowledge to support your hazardous waste determination. <br />Waste testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. <br />Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br />storage and labeling for wastes determined to be hazardous wastes.
