Environmental Health Department <br />AMENDED <br />10/30/2019 <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Date: <br />October 24, 2019 <br /> Facility Address: <br /> 2475 Naglee Rd, Tracy <br /> Facility Name: <br /> ULTA BEAUTY #579 (Tracy) <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 605 CCR 66262.34(f) Failed to completely label containers or portable tanks of hazardous waste. <br />OBSERVATION: Hazardous waste containers were observed on-site with incomplete labeling. <br />1. A Pacifica Aromapower Micro-Batch Perfume Oil was found in a State Managed Waste/ Toxic Hazardous Waste <br />tote (see photos IMG 9012-15). However, when Jasmin Sekhon, Merchandise Service Coordinator, scanned the <br />perfume oil, the hand-held scanner indicated the perfume oil was a flammable liquid (IMG 9016). Jasmin stated the <br />perfume oil should have been placed in the Flammable Liquids and Solids Hazardous Waste tote. The hazardous <br />waste tote that contained the perfume oil was labeled inaccurately for the hazardous property. <br />2. An open basket containing several holes on its sides and located on the ground behind the front cash registers, <br />contained several returned items (see photos IMG 9054-5). Each returned item was affixed with a "Damage Tag" <br />receipt (IMG 9056). Each "Damage Tag" receipt was marked with the following information: "Action: Destroy in <br />Field," which hazardous waste tote the returned item/waste should be placed into, a transaction ID number, a UPC <br />number, a User number, a date and time, and a barcode. According to Jasmin Sekhon, Merchandise Service <br />Coordinator, each day when an item(s) is returned to the store, an employee will scan the item, print out a <br />"Damage Tag" receipt with the current date and time, tape the receipt to the returned item, and place the returned <br />item into the "Damages" basket. According to Jasmin, these damages are placed into the appropriate hazardous <br />waste totes, based on the information marked on the receipt, the morning after the date the item was returned. <br />At the time of inspection, at least two damaged items observed in the Damages basket were affixed with a Damage <br />Tag with a date of "2019-10-23" (IMG 9056). At least one of these two damaged items was marked with "Not <br />Applicable," and did not indicate which hazardous waste tote the damaged item should be placed into. According <br />to Jasmin, damaged items marked "Not Applicable" are placed into a State Managed Waste / Toxic Hazardous <br />Waste tote. <br />At the time of inspection, at least one damaged item, an Urban Decay All Nighter Long Lasting Makeup Setting <br />Spray, was observed with a Damage Tag marked with "Flammable Liquids," indicating the damaged item should <br />be placed into a Flammable Liquids & Solids Hazardous Waste tote (IMG 9057-8). At least one other damaged <br />item, a Macadamia Professional Nourishing Repair Masque, was observed with a Damaged Tag marked with <br />"State Managed Waste," indicated the damaged item should be placed into a State Managed Waste / Toxic <br />Hazardous Waste tote (IMG 9059-60). <br />The open Damages basket described above is missing the words "Hazardous Waste," name and address of the <br />generator, hazardous properties, physical state, composition (contents), and accumulation start date. <br />REGULATION GUIDANCE: All hazardous waste containers shall be marked with the following information: the <br />words “Hazardous Waste”, name and address of generator, hazardous properties, physical state, composition <br />(contents), accumulation start date. <br />CORRECTIVE ACTION: Immediately label the containers as required for hazardous waste.
