S0 JOA U 1 Environmental Health Department <br /> u ; i y <br /> 91 Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> ULTA BEAUTY#314 5410 Pacific Ave, Stockton October 02, 2019 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 405 CCR 66262.34(d)(2) Failed to manage incompatible wastes in containers properly. <br /> OBSERVATION: The following incompatible wastes are stored in a way that is not in compliance with the regulatory <br /> sections listed below: <br /> 1. The following waste items were found inside a container labeled as State Managed Waste/Toxic(ST) Hazardous <br /> Waste(see photos IMG 8442-3): <br /> -A 6.75 oz bottle of Formula 10.0.6 So Totally Clean was identified as a Flammable Liquid And Solid on a <br /> hand-held scanner,which was used by Mercedes Alegre, Prestige Manager, to scan the item (IMG 8448-50). <br /> -A 4 oz bottle and a 1 oz bottle of Urban Decay All Nighter Makeup Setting Spray were labeled as flammable (IMG <br /> 8443). <br /> -A 5 oz aerosol can of KeraColor Color Me Clean Dry Shampoo,which Mercedes stated should have been placed <br /> in the Flammable Gas(FG) Hazardous Waste container(IMG 8451-3). <br /> 2. The following waste items were found inside a container labeled as Oxidizer(OX)Hazardous Waste(IMG 8471, <br /> 8473): <br /> -At least two 2 oz bottles of Redken SEQ Gloss were identified as Flammable Liquid And Solid (FL)on the scanner <br /> (IMG 8475-6). <br /> 3. The waste items listed below were found inside a container that was labeled "Haircolor And Developer Only"and <br /> "OX Hazardous Waste"and observed inside the salon/hair washing area of the facility(IMG 8488-90).According to <br /> Mercedes, items placed into this container are removed and sorted into the appropriate Hazardous Waste <br /> containers in the hazardous waste storage area nightly. <br /> -A 6 oz aerosol can of Paul Mitchell Thermal Protection Hairspray labeled as flammable(IMG 8491-3). <br /> - Four 33.8 fl oz bottle of Red Ken hair conditioner(IMG 8494, 8497).According to the Ulta Potentially Hazardous <br /> Waste Management poster posted in the hazardous waste storage area, hair conditioners are to be placed in an ST <br /> Hazardous Waste container(IMG 8419). <br /> -A 9 oz aerosol can of Wella Stay Essential hairspray(IMG 8497). <br /> -At least two 2 oz bottles of Redken SEQ Gloss,which were previously identified as Flammable Liquid And Solid <br /> on the scanner(IMG 8496). <br /> -At least three 5.5 oz bottles of Redken Chemistry Shot Phix Phase Sealer,which were not given a hazardous <br /> waste classification on the scanner when scanned (IMG 8495-6).The scanner stated "Action: Destroy in Field," <br /> when the item was scanned. Mercedes stated that when the scanner says"Destroy in Field"for an item, but does <br /> not state which hazardous waste container the item belongs in, employees place the item in the ST Hazardous <br /> Waste container. <br /> REGULATION GUIDANCE: <br /> Incompatible wastes, or incompatible wastes and materials shall not be placed in the same container, unless <br /> section 66265.17(b)is complied with. <br /> (b)Hazardous waste shall not be placed in an unwashed container that previously held an incompatible waste or <br /> material. <br /> (c)A container holding a hazardous waste that is incompatible with any waste or other materials transferred or <br /> stored nearby in other containers, or open tanks, shall be separated from the other materials or protected from them <br /> by means of a dike, berm,wall, or other device. <br /> 66265.17(b)Where specifically required by other sections of this chapter,the transfer,treatment, storage, or <br /> disposal of ignitable or reactive waste, and the mixture or commingling of incompatible wastes, or incompatible <br /> wastes and materials, shall be conducted so that it does not: <br /> FA0023322 PR0540794 SCO01 10/02/2019 <br /> EHD 22-01 Rev.9/20/2019 Page 9 of 13 Small Quantity Hazardous Waste Generator OIR <br /> 1868 E.
