SA N J OAQ U I N Environmental Health Department <br /> COUNTY AMENDED <br /> 10/9/2019 <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> ULTA BEAUTY 41152(Lodi) 1 1423 S LOWER SACRAMENTO RD, Lodi October 07, 2019 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br /> OBSERVATION: <br /> 1.When asked how the facility cleans up a chemical/product spill in the facility, Christine Novoa, Merchandise <br /> Service Coordinator,stated employees use Spill Magic(absorbent)to soak up a liquid spill.When asked how the <br /> facility manages the absorbent used to clean up a chemical/product spill, Christine stated that she throws the used <br /> absorbent into the trash.When asked when the most recent spill and clean-up in the facility occurred, Christine <br /> stated a fragrance was spilled and cleaned up about one month ago.According to the Ulta Beauty Retail Stores <br /> Hazardous Waste Training Guide(see photo IMG 8536),found posted above the hazardous waste storage area, <br /> absorbent used to clean up a spilled chemical/product is to placed in a bag, labeled with the brand and product <br /> description, and placed in the In Store Pending Review Damage bin. However, according to Christine,the facility no <br /> longer uses the In Store Pending Review Damage bin, since all damaged product is placed in the hazardous waste <br /> containers. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic,corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately stop disposal of absorbent used to clean-up a chemical/product spill into the <br /> trash, make a hazardous waste determination for each waste, and manage it according to Title 22 CCR. Use Safety <br /> Data Sheets(SDS),waste sampling and test results or other knowledge to support your hazardous waste <br /> determination. Waste testing must be done using methods specified in Title 22 CCR including sections <br /> 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes <br /> determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your <br /> hazardous waste generator status. <br /> This is a Class II violation. <br /> 104 CCR 66262.34(d)(2) No modified contingency plan. <br /> OBSERVATION: A complete modified contingency plan was not posted at the facility. <br /> REGULATION GUIDANCE: The business operator must post the following information next to telephones or in <br /> areas directly involved in the generation and accumulation of hazardous waste: the name and emergency <br /> telephone number of the emergency coordinator, the location of fire extinguishers and spill control material, and the <br /> telephone number of the fire department unless the facility has a direct alarm. <br /> CORRECTIVE ACTION: Immediately post the required information at the facility.
