Christine stated the facility does not mail any manifests anywhere. <br /> REGULATION GUIDANCE: Hazardous waste generators are required to send a copy of the generator signed <br /> UHWM to DTSC by mail.The only exception is when an UHWM starts and finishes as an electronic manifest in the <br /> e-Manifest System. The generator shall within 30 days of each shipment of hazardous waste submit to DTSC a <br /> legible copy of each manifest used.The mailing address is: DTSC Generator Manifests, Department of Toxic <br /> Substances Control, P.O. Box 400, Sacramento, CA 95812-0400. <br /> CORRECTIVE ACTION: Immediately mail a copy of the UHWM numbers 010076568FLE(8/11/2017), <br /> 010788988FLE(1/8/2018), and the UHWMs from the date range of 6/30/2018 to 10/4/2019, and ensure that copies <br /> of all generator signed UHWMs are sent to DTSC within 30 days of shipping the hazardous waste.Also provide a <br /> corrective action statement and supporting documentation to the San Joaquin County Environmental Health <br /> Department(EHD). <br /> This is a Class II violation. <br /> 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br /> OBSERVATION: Designated facility signed copies of Uniform Hazardous Waste Manifest(UHWM)number <br /> 012494967FLE(6/20/2019)was not found on-site(see photo IMG 8565). <br /> REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br /> with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility <br /> which received the waste. This signed copy shall be retained as a record for at least three years from the date the <br /> waste was accepted by the initial transporter. The hazardous waste generator must submit a copy of the manifest <br /> to the California Department of Toxic Substances Control(DTSC)within 60 days if the destination facility signed <br /> manifest copy is not received from the transporter or designated facility. <br /> CORRECTIVE ACTION: Locate a copy of the destination facility signed manifest 012494967FLE(6/20/2019)and <br /> send a copy to the San Joaquin County Environmental Health Department(EHD). If the destination facility signed <br /> manifest cannot be found then send to DTSC a copy of the generator signed manifest and a statement that the <br /> designated facility signed copy was not received by the generator.
