Sanitary Landfill (39-AA-0004) , the Corral Hollow Sanitary Landfill <br /> (39-AA-0005) , and the Lovelace Transfer Station (39-AA-0008) ; and <br /> WHEREAS, the COUNTY operated the Harney Lane Sanitary <br /> Landfill, a solid waste landfill, in conformance with the findings, <br /> conditions, prohibitions, and requirements contained in the Solid <br /> Waste Facilities Permit No. 39-AA-0003, issued by the County <br /> Environmental Health Division as the Local Enforcement Agency for <br /> the BOARD; and <br /> WHEREAS, the COUNTY transferred funds from the Solid Waste <br /> Enterprise Fund into a subbudget unit of the Solid Waste Closure <br /> Enterprise Fund for closure of the Harney Lane Sanitary Landfill <br /> and into a subbudget unit of the Solid Waste Closure Enterprise <br /> Fund for the postclosure maintenance of the Harney Lane Sanitary <br /> Landfill; <br /> NOW, THEREFORE, BE IT RESOLVED that the COUNTY hereby <br /> establishes a Pledge of Revenue from the Solid Waste Enterprise <br /> Fund for postclosure maintenance of the Harney Lane Sanitary <br /> Landfill in accordance with Sections 18283 and 18290 of the <br /> Regulations. <br /> BE IT FURTHER RESOLVED that the Harney Lane Sanitary Landfill <br /> subbudget unit for postclosure maintenance activities is removed <br /> from the Solid Waste Closure Enterprise Fund. <br /> BE IT FURTHER RESOLVED, that on the effective date of the <br /> Pledge of Revenue, current funds contained in account number 33- <br /> 000057-0071-0108 of the Solid Waste Closure Enterprise Fund for <br /> postclosure maintenance of the Harney Lane Sanitary Landfill, are <br /> transferred to account number 33-000057-0071-0107 for the closure <br /> of the Harney Lane Sanitary Landfill. <br /> BE IT FURTHER RESOLVED that disbursement of funds for <br /> postclosure maintenance shall be in accordance with Section 18262 . 3 <br /> of the Regulations. <br /> I <br /> BE IT FURTHER RESOLVED that, in the event the BOARD determines <br /> that the COUNTY has failed or is failing to perform postclosure <br /> maintenance as required by law, the BOARD may direct the COUNTY to <br /> pay from the pledged revenues such amounts as are necessary to <br /> inspre sufficient postclosure maintenance. The COUNTY shall be <br /> obligated to use such funds for postclosure maintenance in <br /> accordance with the directives of the BOARD. <br /> BE IT FURTHER RESOLVED that the Director of the Department of <br /> Public Works shall be responsible for tNi administration of said <br /> financial assurance. <br /> BE IT FURTHER RESOLVED that the Director of the Department of <br /> Public Works is directed to produce an annual report for <br /> transmittal to the BOARD, containing as appropriate, a revised <br />
