CRITICAL HABITAT: The site is not in designated critical habitat for California red- <br /> legged frog (USFWS, 2006), federally listed vernal pool shrimp or plants <br /> (USFWS, 2005a), California tiger salamander (USFWS, 2005b), valley elderberry <br /> longhorn beetle (USFWS, 1980), delta smelt (USFWS, 1994), Central Valley <br /> steelhead (NOAA, 2005), or any other federally listed species (Attachment E). <br /> SAN JOAQUIN COUNTY MULTI-SPECIES HABITAT CONSERVATION AND OPEN SPACE <br /> PLAN (HCP): The project will participate in the (HCP (SJCOG, 2000), which <br /> involves the payment of fees and implementation of ITMMs to avoid impacts on <br /> nesting birds and other special-status species. <br /> A majority of the site falls into the "Agricultural Habitat Open Spaces" pay zone <br /> and Duck Creek falls under the "Natural Lands Habitat: pay zone (Attachment E). <br /> Respective per-acre fees associated with these pay zones will need to be paid in <br /> order to participate in the HCP; the upcoming (i.e., 2022) fee for both <br /> classifications is $19,561.00 per-acre. <br /> Conclusions and Recommendations <br /> • The site consists of disked grassland that is biologically unremarkable, a <br /> few trees, and a portion of Duck Creek. <br /> • Duck Creek is the only jurisdictional Waters of the U.S. or wetland in the <br /> site. The project will involve no work in Duck Creek. <br /> • Due to a lack of suitable habitat, it is unlikely that special-status plants <br /> occur in the site. <br /> • With the exception of Swainson's hawk, burrowing owl, white-tailed kite, <br /> and western pond turtle, no special-status wildlife species are expected to <br /> occur in the body of the site on more than a very occasional or transitory <br /> basis.
