SANJOAQUIN <br /> Environmental Health Department <br />.t —COUNTY— <br />c•mr—'—r <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: BURLINGTON NO & SANTA FE RR CO Date: Sep 01, 2020 <br />RP Mailing Address: 740 E CARNEGIE DR Record ID#: COGBANCPA <br /> <br />SAN BERNARDINO, CA 95215- Program Element: 2546 <br /> <br />Spill Location: 6540 S AUSTIN RD, STOCKTON Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />REPORTED APPROXIMATELY 5,000 CUBIC FEET OF LIME POWDER RELEASED ON MAIN TRACK OF STOCKTON <br />RAIL YARD. <br />OBSERVATIONS: <br />Met with John Brainard, Supervisor and Shannon Swagerty, Manager. John stated that he checked the main track and could <br />not observe lime powder on the tracks. He stated that the hopper and Patriot Environmental are in the stockton rail yard <br />located on 720 B. Street to clean-up any lime powder that accumulated on the tracks. Potentially 7 miles of track from the <br />Austin Rd location to the B. street location were impacted by lime powder. <br />All generated clean up wastes must be transported according to all applicable manifesting procedures (HSC25160 (b)(3)) <br />and disposed of according to all applicable Title 22 regulations. The disposal of any hazardous waste, or the causing <br />thereof, is prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. <br />[HSC25189.5 (a).] <br />VIOLATIONS: <br />" Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />Immediately make a hazardous waste determination for the lime powder. <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />EHD 25-01 Rev 8/18/2020 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE Page 1 of 2 <br />1868 E.
