Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />April 12,2021 <br />Facility Address: <br />2300 W Alpine Ave, Stockton <br />Facility Name: <br />Michael's New York Style Pizza, Inc <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR -Notice to Comply) <br />RemarksItem # <br />11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br />OBSERVATION: Employee training records have not been provided. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel <br />receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a <br />release or threatened release of a hazardous material, including, but not limited to, familiarity with the following <br />plans and procedures: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br />years. <br />CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br />training records to the EHD. <br />This is a Class II violation. <br />12 HSC 25505(c) Failed to have the HMBP readily available to facility or EHD personnel. <br />OBSERVATION: Employee did not have access to the HMBP at the facility. <br />REGULATION GUIDANCE: The emergency response plans and procedures, the inventory of information required <br />by this article, and the site map required by this section shall be readily available to personnel of the business or the <br />unified program facility with responsibilities for emergency response or training pursuant to this section . <br />CORRECTIVE ACTION: Immediately make arrangements to have the business plan readily available for review. <br />This is a Class II violation. <br />Overall Inspection Comments: <br />Conducted in-office Hazardous Materials Business Plans (HMBP) inspection. The food inspector, Maribel <br />Flohrschutz, performed an on-site inspection for the CO2 tank on January 5, 2021. <br />There were 8 violations during the in-office inspection. complete and submit a copy of the Return to Compliance <br />Certification form to the EHD with a statement documenting the corrective actions that have been or will be <br />taken for each violation, and any supporting paperwork, by May 12, 2021 . <br />Requests for submittal of employee training records were completed on 2/8/21, 2/26/21, 3/23/21 and 4/8/21.
