OBSERVATION: The facility did not have exception reports on site for Uniform Hazardous Waste Manifests (UHWM)for 003699380GBF (9/19/2019). REGULATION GUIDANCE: (a)A generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the designated facility within 35 days of the date the waste was accepted by the initial transporter shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the hazardous waste. (c)A hazardous waste generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste is submitted,within 60 days from the date that the hazardous waste was accepted by the initial transporter, shall submit to the department a legible copy of the manifest,with some indication that the generator has not received confirmation of delivery. (d)Generators shall submit the information to the department at: DTSC Report Repository, Generator Information Services Section, P.O. Box 806, Sacramento, CA 95812-0806 CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San Joaquin County Environmental Health Department(EHD). If the destination facility signed manifests cannot be found then send to DTSC a copy of each generator signed manifest and a statement that the designated facility signed copy was not received by the generator. DTSC address is DTSC Report Repository, Generator Information Services Section, PO Box 806, Sacramento, CA 95812-0806. Provide a corrective action statement to the EHD within 30 days. This is a repeat violation, Class II. 117 HSC 25185(c)(3) Failed to submit a written response within 30 days of receiving an inspection report. OBSERVATION: This business did not provide a written response to the inspection report dated 11/21/2018 within 30 days. The report was delivered to the business on 11/21/2018. REGULATION GUIDANCE: The operator of the site or facility which receives an inspection report shall submit a written response to the department or the local officer or agency authorized to enforce this chapter pursuant to subdivision (a)of Section 25180 within 60 days of receipt of the inspection report, or within a shorter time as the department or the local officer or agency may reasonably require,which shall include a statement documenting corrective actions taken by the operator or proposing corrective actions which will be taken by the operator,for purposes of compliance with this chapter, or disputing the existence of the violation. The local agency,the San Joaquin County Environmental Health Department, requires response within 30 days. CORRECTIVE ACTION: Provide a corrective action statement and supporting documentation to the San Joaquin County Environmental Health Department. This is a Class II violation.
