<br />Environmental Health Department SAN JOAQUIN <br />co U N 1 Y <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: PACIFIC GAS & ELECTRIC <br /> Date: Jun 28, 2020 <br />RP Mailing Address: PO BOX 7640 Record ID#: CO2ZNEZOF <br />SAN FRANCISCO, CA 94120- Program Element: 2546 <br />Spill Location: 10770 E MONTCURE RD, RIPON <br /> <br />Release/Spill Response (excluding Joint Team) <br /> <br />NATURE OF WASTE DISCHARGENVASTE RELEASE: <br />APPROXIMATELY 3-GALLONS OF MINERAL OIL RELEASED FROM POLE MOUNTED TRANSFORMER. <br />OBSERVATIONS: <br />Contacted Dave Larsen, PGE, he stated clean-up has already been performed and mineral oil sample has been taken. He <br />stated that two 55-gallon drums with soil contaminated with mineral oil were generated. <br />Please be advised that the disposal of any waste [HSC 5411] or disposal of any hazardous waste, or the causing thereof, is <br />prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. <br />[HSC25189.5(a).]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste shall <br />be disposed of under appropriate hazardous waste manifesting procedure [HSC 25160 (b)(3)]. Provide a copy of the waste <br />sample analytical results prior to disposal of the waste, and the waste/hazardous waste disposal records to the EHD for all <br />clean up debris associated with this spill clean up. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />° Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />° Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately. <br />Submit copies of hazardous waste manifests/disposal records to the END. <br />For the two 55-gallon drums with soil contaminated with mineral oil and any additional hazardous waste generated <br />during clean-up, please manage according to Title 22 California Code of Regulations for hazardous waste.
