<br />Environmental Health Department SAN JOAQUIN <br />1, <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: PGE <br /> Date: Dec 29, 2020 <br />RP Mailing Address: PO BOX 7640 <br /> Record ID#: CO9ACHSRY <br />SAN FRANCISCO, CA 94120- Program Element: 2546 <br />Spill Location: 21915 SEXTON RD, ESCALON <br /> Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />APPROXIMATELY 25 GALLONS OF MINERAL OIL RELEASED ON TO SOIL DUE TO TRACTOR INCIDENT. <br />OBSERVATIONS: <br />Received call from Celia Barajas, Environmental Field Scientist, PGE. Contracted PSC to perform clean up. <br />Clean up has not been verified. <br />Please be advised that the disposal of any waste [HSC 5411] or disposal of any hazardous waste, or the causing thereof, is <br />prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. <br />[HSC25189.5(a).]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste <br />manifesting procedure [HSC 25160 (b)(3)]. Provide a copy of the waste <br />sample analytical results prior to disposal of the waste, and the waste/hazardous waste disposal records to the EHD for all <br />clean up debris associated with this spill clean-up. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br /> <br />CORRECTIVE ACTIONS / ORDER: <br />" Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />For all waste generated from clean up of soil impacted with 25 gallons of transformer oil. Please manage according to <br />Title 22 California Code of Regulations for hazardous waste.
