During my June 2, 20 inspection I observed eleven lead acid truck batteries. What happened to these batteries
since they were not observed on-site today? If they were taken to a battery recycler in California or Illinois,
provide a receipt or name/address of the receiving facility.
2. During my June 2, 20 inspection I observed four 55-gallon containers of used oil. What happened to this used oil
since the drums were not observed on-site today? If the used oil was hauled to Illinois, provide the Illinois
recycling receipt.
3. We discussed today that your facility is currently taking all trucks to local service providers for repairs and
maintenance. The only service done on-site is an occasional replacement of a lead acid battery . A core receipt
was reviewed showing the used batteries are by a battery recycler in Lathrop. Ten cores or less per year will
not require a hazardous waste generator permit with my department if the cores are taken to a recycler. Please
provide an estimate of lead acid battery core exchanges that will take place in a year.
4. Confirm in writing that all oil and oil filter changes are being done at local service shops.
5. Folk lift propane containers were observed stored in a cage. The containers hold 9.5 gallons each. Five
containers were full so 47 gallons of propane were stored on site. Four containers were empty, waiting to be
refilled. You stated that the propane delivery service will be changed so that the site will never store more than
55 gallons of propane on-site. Please verify this statement in writing.
Also see the attached guidance for the Hazardous Materials Business Plan (HMBP) and lead acid battery reporting. Lead
acid battery reporting is based on the amount of sulfuric acid in the batteries. 55 gallons or more of sulfuric acid in the
batteries on-site is reportable for the HMBP program. No lead acid batteries were observed onsite.
More HMBP guidance is here toward the bottom of the page: https://www.caloes.ca.gov/individuals-
families/hazardous-materials/hazmat-business-plan
Send a response to the five questions above to resolve the hazardous waste generator violations,
Garrett Backus, Ld.
