Scott Long 2 10 January 2005 <br />Long Ranch, Inc. <br />Due to the failure to submit the required report pursuant to Section 13267 of the California Water Code, <br />staff's usual next step is to recommend to management that civil liability (i.e., monetary penalties) be <br />assessed against the Discharger. As of 5 January 2005, the maximum liability for the delinquent <br />report listed above is $158,000, as shown in the enclosed table. <br />However, staff will not recommend that the Executive Officer issue an Administrative Civil Liability <br />Complaint if the delinquent report is submitted by 31 January 2005. Alternatively, you may submit a <br />report by 31 January 2005 stating the changes that you will make to ensure that future monitoring <br />reports are submitted in a timely manner. Note that submittal of this alternate report will not provide <br />protection against issuance of civil liability if future monitoring reports are again delinquent. Finally, the <br />second semiannual monitoring report for 2004 is due by 31 January 2005. <br />If any or all of these reports are not received by the above dates, staff will recommend the issuance of an <br />Administrative Civil Liability Complaint.
