The diesel spill was within 150 feet of a dry canal belonging to the Banta-Carbona Irrigation <br />District. The diesel spill was from a fuel tank on a refrigeration trailer, which was being transported by Subedar Trucking Inc. <br />truck (CA-496862, ICCMC-996641, US DOT-2944923, VIN-GJ104410). <br />All Environmental Services applied absorbent to the asphalt shoulder. CalTrans used a sweeper vehicle to pick up the used <br />absorbent, which according to John Miller, CalTrans Maintenance Area Superintendent, will be transported to the Caltrans <br />Stockton yard and placed into a drum for storage until disposal. All Environmental Services covered the diesel-contaminated <br />soil with visqueen and sandbags until the spill cleanup is scheduled. <br />Please be advised that the disposal of any waste [HSC 5411] or disposal of any hazardous waste, or the causing thereof, is <br />prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. [HSC 25189.5 <br />(a).]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting <br />procedure [HSC 25160 (b)(3)]. Notify the EHD when the clean-up is complete in order for the EHD to verify. Provide all <br />hazardous waste determinations, sample analytical results, and waste/hazardous waste disposal records to the EHD for all <br />clean up debris associated with this clean up. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />ORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Immediately.
