Box 1810 <br /> Stockton, CA 95201 <br /> Subject: PLEDGE OF REVENUE AGREEMENT FOR POSTCLOSURE MAINTENANCE <br /> FOR HARNEY LANE SANITARY LANDFILL 39-AA-0003. <br /> Dear Mr. Selling: <br /> This letter is to point out areas of concern in the draft Pledge <br /> of Revenue Resolution and Agreement that were submitted to the <br /> Board for review. <br /> The documents may be approved with some changes. Enclosed is a <br /> copy of the latest draft Resolution and Agreement with our <br /> suggested language changes and additions noted in ,green ink for <br /> your convenience. The items noted below are addressed separately <br /> for clarity. <br /> 1. Agreement. Add a new title for clarity, revise as follows: <br /> PLEDGE OF REVENUE AGREEMENT FOR FINANCIAL ASSURANCE FOR <br /> POSTCLOSURE MAINTENANCE OF THE HARNEY LANE SANITARY LANDFILL <br /> UTILIZING SOLID WASTE ENTERPRISE FUND REVENUES. <br /> 2. Agreement, page 2, paragraph 4. Replace this paragraph with <br /> the following paragraph: WHEREAS, the COUNTY has determined <br /> that projected net revenues from said fund, derived from <br /> user fees charged for the use of the Counties solid waste <br /> facilities which include: the North County Recycling Center <br /> and Sanitary Landfill (39-AA-0022) , the Foothill Sanitary <br /> Landfill (39-AA-0005) , and the Lovelace Transfer Station <br /> (39-AA-0008) , during the thirty year period of postclosure <br /> maintenance of the LANDFILL shall be greater during each <br /> year of this period than the yearly monitoring and <br /> postclosure maintenance cost contained in the most recent <br /> cost estimates for LANDFILL, which has been submitted to the <br /> BOARD in accordance with Section 18266 of the Regulations; <br /> 3. Agreement, page 3, paragraph 6.
