substantial improvements of any structures, including conversion of existing structures, shall be elevated <br /> or flood proofed in accordance to San Joaquin County Development Title Section 9-1605.12(a)(b) and (c). <br /> The septic system is also required to be constructed on the elevated pad. Because of this requirement EHD <br /> also required a Soil Suitability/Nitrate Loading Study (SSNL) prior to project level approval to determine <br /> whether the location of the septic system is adequate. According to EHD, the SSNL Study and onsite <br /> wastewater treatment system designed by an engineer was reviewed by Questa Engineering Corp, dated <br /> September 6, 2019 and the response, dated November 20, 2019. The results were determined to be <br /> adequate. <br /> Animal Processing Operations <br /> The applicant's animal processing activities will be small in scope. The applicant states that an average of <br /> one (1) animal per day will be processed, but that the activity may not occur every day. After processing, <br /> the applicant will take the renderings and place them in a sealed container to be delivered directly to the <br /> tallow plant for disposal.The applicant has provided confirmation from a bona fide operator(Sisk Recycling, <br /> memo dated June 5, 2019) stating that it has the capacity to accommodate the tallow generated from this <br /> animal processing operation (See Attachment B, Response Letters). Additionally, the proposed facility will <br /> be regulated by the California Department of Food and Agriculture(CDFA).The CDFA requires any building <br /> permitted for animal processing to have a concrete floor so that the ground and groundwater is not <br /> contaminated with animal wastes. A 1,600 square-foot portion of a 4,000 square-foot building is proposed <br /> for animal processing. Pursuant to Development Title Section 9-605.3(a), the applicant could potentially <br /> expand the existing building up to 25% provided the proposed expansion, in the opinion of the Director, will <br /> not have a substantial, adverse effect on adjacent property(ies). If an expansion exceeds 25%of floor area, <br /> a new land use permit is required. <br /> Chicken Ranch Operations <br /> Development Title Table 9-1045.3 states that a maximum of 35 chickens may be permitted on parcels three <br /> (3)acres or larger, and only three(3)may be roosters.An approved discretionary application for the Animal <br /> Raising-Small use type is required for projects that will exceed this number of chickens. The applicant <br /> submitted a revised Manure Management Plan (MMP) dated September 10, 2020 for review, and this <br /> version of the plan was ultimately approved by EHD. This MMP, which has been updated multiple times, <br /> states that approximately 5 cows and 50 sheep will be on site in addition to the 1,000 chickens. Manure will <br /> be raked up from pens twice a week and stored in a fully enclosed four (4) sided 100 square foot fully <br /> enclosed building. The building doors will open on the east side, which is opposite the predominate wind <br /> direction. The building will open wide enough to allow accessibility with a front-end loader. The approved <br /> MMP includes details that are consistent with the information contained in the Initial Study and Mitigated <br /> Negative Declaration. In addition, the applicant will be required to remove manure from the animal <br /> enclosures a minimum of twice a week, store the manure within an enclosed building, and remove manure <br /> from the site a minimum of one (1) time per week to an approved disposal site (this requirement is also <br /> included in the Community Development Department conditions of approval). The applicant states he <br /> intends to use one of two bona-fide operators for manure disposal; Ralph Hayes and Sons, Inc., or Keifer <br /> Landfill in Sacramento County.The applicant may also choose to dispose of manure at a different reputable <br /> company that will accept animal waste. <br /> Modification Request <br /> The applicant has requested a surfacing modification request to use asphalt grindings in lieu of asphalt <br /> concrete or Portland cement concrete for all access, circulation and parking areas. Development Title <br /> Section 9-1015.9 states that requirements of the chapter may be modified by the Director in cases in which, <br /> due to the unusual nature of the establishment proposed or the development proposal submitted for it, the <br /> requirements set forth in the Chapter may be considered insufficient or excessive.
