The LUC was recorded on January 9, 2015, and is <br /> stamped with Document #: 2015-002516. DTSC requires a LUC to prevent <br /> inappropriate land use activities due to residual hazardous substances contained in the <br /> subsurface soils at the Site. Previous environmental investigations at the Site identified <br /> the following contaminants at concentrations in on-site soils that require use restrictions: <br /> Arsenic, Chromium, Lead and the petroleum compound Diesel. <br /> The LUC can be removed from the property by reducing, or removing, the contaminants <br /> in the soil to unrestricted land use levels. While the LUC is in place for the Site the <br /> DTSC approved Soil Management Plan dated March 26, 2014, or another Soil <br /> Management Plan approved by DTSC, is required for compliance with the LUC. <br /> Please note that Sections 4.04 and 4.05 of the LUC require an annual inspection by <br /> January 15th of each year, and a Five Year review and re-evaluation report every five <br /> years after the recordation of the LUC, respectively. Also note that Section 3.05 of the <br /> LUC identifies that the Site Owner agrees to pay DTSC's costs in administering the <br /> LUC, should there be any.
