The <br /> LUC was recorded on March 5, 2014, and is stamped Document # 2014-021391. <br /> DTSC requires a LUC to prevent inappropriate land use activities due to residual <br /> hazardous substances contained in the subsurface soils at the Site. Previous <br /> environmental investigations at the Site identified the following contaminants at <br /> concentrations in on-site soils that require a land use restriction: Beryllium and <br /> Polycyclic Aromatic Hydrocarbons. <br /> The LUC can be removed from the property by reducing, or removing, the contaminants <br /> in the soil to unrestricted land use levels. While the LUC is in place for the Site, the <br /> DTSC approved Soil Management Plan dated October 8, 2013, or another Soil <br /> Management Plan approved by DTSC, is required for compliance with the LUC. <br /> Please note that Sections 4.04 and 4.05 of the LUC require an annual inspection by <br /> January 15th of each year, and a Five Year review and re-evaluation report every five <br /> years after the recordation of the LUC, respectively. Also note that Section 3.05 of the <br /> LUC identifies that the Site Owner agrees to pay DTSC's costs in administering the <br /> LUC. <br /> ® Printed on Recycled Paper <br />
