The <br /> Department of Toxic Substances Control (DTSC) requires a LUC to prevent <br /> inappropriate land use activities due to residual hazardous substances contained in the <br /> soils beneath the Site. <br /> The signed LUC must be recorded with the local County Assessor/Recorder office <br /> before DTSC can issue a No Further Action (NFA) letter for the Site. The enclosed LUC <br /> has been returned for recording with the County. After recording, two copies of the LUC <br /> must be returned to DTSC at the address on the letterhead. Upon receipt of the copies <br /> of the recorded LUC, DTSC will issue an NFA letter for the Site. <br /> Please note that Section 4.04 of the LUC requires the submittal of an annual inspection <br /> to DTSC by the 15th of January of each year. Also, Section 4.05 of the LUC requires <br /> submittal of a review and reevaluation every five (5) years whether human health and <br /> the environment are adequately protected by the LUC. Finally, please note that Section <br /> 3.05 of the LUC is an agreement to pay DTSC costs associated with administering this <br /> LUC. <br /> 9 Printed on Recycled Paper <br />
