VFF is not permitted to discharge into an unlined percolation <br /> pond because this action would violate Order No. 90-047 which prohibits the <br /> discharge of wastewater except to the EESB. <br /> In regards to the EESB having reached storage capacity because suspended solids <br /> levels have restricted the use of the injection well , Order No. 90-047, Discharge <br /> Specification C.8. clearly states: <br /> " In the event that the EESB has been shut down for repairs, the remainder <br /> of the pretreatment plant may be operated only if discharge limitations <br /> are met and the effluent is injected in full compliance with the UIC <br /> permit. Failure of the pretreatment plant to treat unequalized flows to <br /> within discharge limitations will necessitate the Discharger ceasing all <br /> wastewater discharges until appropriate repairs are made." <br /> While we are aware that VFF is working to resolve the present problems with the <br /> wastewater disposal system, we can not authorize VFF to discharge wastewater to <br /> the uniinea existing ponds in violation of Order No. 90-047. in addition to <br /> violating Order No. 90-047 such a discharge could exacerbate the current ground <br /> water pollution at the site. A decision to discharge to the unlined pond could <br /> result in VFF incurring an administrative civil liability for violating its waste <br /> discharge requirements. <br /> If you have any questions, please contact me at (916) 361-5737. <br /> ROBERT A.
