Spill has been contained. Some of the diesel went into the storm drain. Facility <br /> has a retention pond. <br /> OBSERVATIONS: <br /> Approximately 25-50 gallons of diesel was released from a damaged truck. Diesel impacted ground and storm drain. Storm <br /> drain leads to a retention pond. Ponder Environmental is on site conducting clean up. Concrete will be cleaned and storm <br /> drain will be hydro-jetted. There is a waste tank on site for collecting the contaminated water. <br /> Pilot Travel Center Lathrop- 1017 to abate contamination and notify SJC EHD when clean-up is complete for verification. <br /> Pilot Travel Center Lathrop- 1017 to provide SJC EHD with disposal records for waste generated and any analytical results <br /> or waste profile. <br /> VIOLATIONS: <br /> Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> • Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> ° Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Immediately <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Within 30 days <br /> • Other Correction <br /> If any lab analysis is done on the waste generated provide a copy to SJC EHD <br /> EHD 25-01 Rev.08/17/17 Page 1 of 2 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br /> 1868 E.
