111'1-BTR'l1P 1120-1.3 <br /> Ahem Ruad•Vvim45 <br /> Legal-Site Acccss-Sandhu <br /> SITE ACCESS AGREEMENT <br /> THIS SITE ACCESS AGREEMENT ("Agreenrent") is entered into by and between <br /> CHEVRON ENVIRONMENTAL MANAGEMENT COMPANY ("EMC"), a California <br /> corporation, and KARNAIL SANDHU ("Owner"). <br /> RECITALS <br /> A. Owner holds record title to certain real property located at Assessor's Parcel <br /> Number 255-180-15,34701 S Welty Road, in the City of Vernalis, County of San Joaquin, State of <br /> California(the"Property"); <br /> B. Standard Oil Company of California, a predecessor to Chevron U.S.A. <br /> ("Chevron"), operated a crude oil pipeline on property adjacent to the Property; <br /> C. CMC manages work associated with the Chevron pipeline on behalf of Chevron; <br /> D. EMC seeks Owner's authorization to access the Property to conduct the Work, as <br /> defined in Paragraph l (Rights Granteco below;and <br /> E. Owner is willing to grant EMC access to the Property for the above-described <br /> purposes. <br /> TERMS AND CONDITIONS <br /> NOW, THEREFORE, in consideration of the mutual covenants and promises herein, <br /> the parties hereby agree as follows: <br /> 1. RIGHTS GRANTED <br /> Owner hereby grants to EMC, its employees, agents, representatives, consultants <br /> and contractors, a license over, under and across the Property for the purpose of performing <br /> environmental assessment activities (the "Work"). Said Work may include, but not be limited <br /> to, soil,vapor and groundwater sampling. <br /> 2. PEFORMANCE OF THE WORK <br /> EMC agrees, at its sole cost and expense, to conduct and perform the Work in a prompt, <br /> safe, efficient and workmanlike manner and in compliance with all applicable federal, state or <br /> local laws,regulations or ordinances. <br /> 3. TERM <br /> The license granted herein shall terminate upon completion of the Work. <br /> 4. RESTORATION <br /> If entry onto the Property by EMC, or exercise by EMC of any of its rights or obligations <br /> under this Agreement, result in any physical damage to the Properly (ordinary wear and tear <br /> - I - <br />
