Box 6012 <br /> San Ramon, CA 94583 <br /> NO FURTHER ACTION REQUIRED, HISTORICAL CRUDE OIL PIPELINES, US CAN-WELTY <br /> ROAD, 35275 WELTY ROAD, VERNALIS, SAN JOAQUIN COUNTY <br /> Chevron Environmental Management Company (Chevron) submitted a No Further Action Required <br /> Request Report (Report), dated 24 September 2013, for the US Can-Welty Road project. The <br /> Report summarizes various investigations in support of the no further action request for the <br /> historical Tidewater Associated Oil Company (TAOC) and Old Valley Pipeline (OVP) US Can-Welty <br /> Road crude oil pipelines project (Site). The Site is located at the intersection of Welty Road and <br /> California State Highway 33, south of the rural community of Vernalis, San Joaquin County. Central <br /> Valley Regional Water Quality Control Board staffs (Staff) evaluation of the NFAR request is <br /> presented in the enclosed memorandum. <br /> The Site encompasses portions of the State Highway 33 and the Union Pacific Railroad (UPRR) <br /> right-of-way (ROW) easements, and commercial/rural/agricultural properties along both sides of the <br /> highway and tracks. The historical pipelines were located on the west side of and within the UPRR <br /> easement. Surrounding land use is primarily agricultural, rural residential and light commercial and <br /> industrial businesses. Nearby Chevron OVP/TAOC sites have been or are being addressed with <br /> regulatory oversight provided by Staff. <br /> Based on the warranties and certifications by Chevron and its consultants, that the information was <br /> accurate and representative, a no further action required determination is appropriate for the <br /> subject property. Please be advised that this letter does not relieve Chevron of any liability under <br /> the California Water Code or Health and Safety Code for past, present, or future operations at the <br /> Site. Nor does it relieve Chevron of any responsibility to clean up existing, additional, or previously <br /> unidentified conditions associated with historical OVP/TAOC crude oil leaks at the Site that cause <br /> or threaten to cause degradation or nuisance or otherwise pose a threat to water quality or public <br /> health. <br /> Any person aggrieved by this action may petition the State Water Resources Control Board (State <br /> Water Board) to review the action in accordance with Water Code section 13320 and California <br /> Code of Regulations, title 23, sections 2050 and following.
