Box 1810 <br /> Stockton, CA 95201 <br /> REQUEST FOR RESPONSE TO A RELEASE, HARNEY LANE SANITARY LANDFILL, SAN <br /> JOAQUIN COUNTY <br /> The Central Valley Regional Water Quality Control Board (Central Valley Water Board)staff <br /> has reviewed the 1st Quarter 2009 Groundwater and Surface Water Monitoring Report for the <br /> Harney Lane Sanitary Landfill. The report was prepared in accordance with Waste Discharge <br /> Requirements (WDRs) Order No. 96-139. The groundwater beneath the Harney Lane Landfill <br /> has been affected by landfill gas as reported by detections of volatile organic compounds <br /> (VOCs) in well MW-2 and now well MW-4. VOCs detected in well MW-4 have been confirmed <br /> through re-testing, indicating a "measurably significant" release to the environment. <br /> In accordance with Title 27, §20385 (a)(2), the Discharger shall institute an evaluation <br /> monitoring program (EMP) under §20425 whenever there is "measurably significant" evidence <br /> of a release from the Unit during a detection monitoring program. In accordance with Title 27, <br /> §20420(k)(5)(A-D), the Discharger is required to submit an Amended Report of Waste <br /> Discharge to establish an EMP within 90 days of determining a "measurably significant" <br /> evidence of a release. Based on the data collected from the EMP, the Discharger shall <br /> update the engineering feasibility study (EFS) for corrective action required pursuant to <br /> §20420(k)(6). The due date for the EMP report is roughly 90 days (11 August 2009) from the <br /> date of this letter. The EFS report is due roughly 180 days (11 November 2009) from the date <br /> of this letter. These due dates are consistent with the Title 27 requirements. <br /> Summary of Pending Due Dates <br /> Updated WDRs for the Harney Lane Landfill were adopted by the Central Valley Water Board <br /> during the April 2009 meeting. Finding No. 35 of WDR Order No. R5-2009-0049 states in part <br /> that MW-1 may not be suitable as a background monitoring well for monitoring parameters <br /> that can be affected by LFG, such as alkalinity,,TDS and specific conductance. To resolve <br /> this issue, Provision G.5 of the WDRs requires that the Discharger establish a background <br /> monitoring well a sufficient distance from the landfill to be outside the influence of LFG and <br /> any potential landfill leachate impacts.
