UNIT IV <br />VOLUNTARY CLEANUP OVERSIGHT PROGRAM AT NON-UST SITES <br />Voluntary Cleanup Sites: <br />Simple waste spills at sites where soil/water samples tested with detectable levels of waste, as defined <br />in H&S Section 101075 (b) (i.e. Sites ER team responded to a waste spill, Phase II investigations). <br />Cleanup Sites that do not qualify and must have oversight by SB or DTSC: <br />DISC UST site under clean up, per H & S, Section 25355.5 <br />DISC order for imminent HW release threat, per H&S, Section 25358.3 <br />DISC cleanup site, per H&S, Section 25355 <br />Site subject to cleanup and abatement by RWQCB, per Water Code, Section 13304 <br />Site regulated by a Solid/Hazardous Waste Management Unit, per H&S, Section 25200.10 <br />Phase I for a Hazardous Waste Facility, per H&S, Section 25200.14 <br />Authority: <br />H & S Code Section 101480 6(b); Allows a RP and local environmental health agency to enter into a <br />written agreement for the cleanup of a simple waste spill that specifies the testing, monitoring, and <br />analysis the RP will carry out to determine the type and extent of the contamination, specifies the <br />remedial actions, and establish the cleanup goals. It allows a local EHD agency to supervise the <br />remedial action, set cleanup goals, and issue a letter that certifies the cleanup goals were <br />accomplished. <br />Process by Unit III or Unit IV staff: <br />If analytical results find soil/water contaminated with detectable levels of Waste then: <br />1. Place on SJC Contaminated Site data base list (Bonnie or Kim can help with this process). <br />2. Complete Prop 65 Notice, if waste is hazardous material. <br />3. Refer cleanup to appropriate State agency (DISC or RB), using EH-48-051 form. <br />a. If site qualifies, additionally refer RP to SJC EHD Unit IV for clean up oversight. <br />4. Complete MFR with Program Element of: <br />2961-DTSC's Voluntary Program or 2970- RELEASE SITE-No Assigned Lead Agency, <br />Generate a PR # and RO # for the site in Envision. <br />5. RP requests local oversight of their voluntary cleanup by EHD. <br />DISC and RB MUST be notified by EHD 10 days before RP and EHD can enter into a <br />written contract, per Section 101480 (c). Use the EHD Voluntary Cleanup CVRWSQCB/ <br />DTCS 10 Day Notification templates for this purpose. <br />RP and EHD Unit IV may enter into a written contract if: <br />i. DISC & RB decline oversight, <br />EHD agrees to supervise remediation; & <br />EHD has adequate staff, resources, technical expertise, and capabilities; <br />6. RP enters into a contract with EHD by completing and signing the EHD Remedial Action <br />Agreement, MFR pink and green forms, & payment to EHD of 5 hr x WLR for EHD staff and PG <br />oversight activities, <br />EHD can withdraw from agreement at anytime, per Section 101480 (d); <br />If more than five hours of EHD's time is expended on oversight activities, the billable <br />party identified on the MFR will be billed for the additional charges, <br />EHD Staff and PG to record on their dailies time spent performing oversight activities to <br />PE 2953, SC 310, 312, 315, or 933, and PR#. This time is separate from Well & Boring <br />permit issuance and inspection activities that are recorded to PE 2901, 2902, 2905; SC <br />313 & 314; and SR # noted on Well & Boring Permit. The PE code of 2903 and PR # will <br />be noted on the Well & Boring Permit for the Inspection activity fee, and linking the SR to <br />the PR, but no time will be applied to PE 2903 or the PR# for this activity. <br />The Unit IV Program Coordinator submits the closure letter to the Director for signature, <br />once Unit IV PG and DISC supports closure of the site.
