_ 2 _ Provide the names and addresses of any individuals who received or may have received asbestos-bearing wastes from the site. Provide the locations and addresses at which asbestos- bearing wastes from the site were or may have been dis- posed. Describe any contractual relationship between Johns Manville and the persons or entities identified in your response to questions 2(a) through 2(d). Please provide any information or knowledge you may have (including information in your records or from any of your employees) concerning the disposal of asbestos-bearing wastes at the Equinoa Property at 4599 Manthey Road, French Camp, California. Please provide all documents related to asbestos disposal practices conducted by Johns Manville that are in your pos- session, including but not limited to: invoices, contracts, accounts payable, trip tickets, weight certificates. Provide the names of: a) the persons who prepared the responses to each of the above questions and, b) the persons who provided information for the preparation of the responses to the above questions. Please provide the names of current employees of J. M. Manufacturing who formerly worked for Johns Manville. Your response to this request for information must be sent to EPA at the above address within fifteen (15) calendar days of your receipt of this letter. Under Section 104(e)(5) of CERCLA as amended, 42 U.S.C. 9604(e)(5), failure to comply with this re- quest may result in an Order requiring compliance or a civil ac- tion for appropriate relief, including penalties. Failure to comply with this request may also result in a civil enforcement action against you by EPA. EPA regulations governing confidentiality of business infor- mation are set forth in Part 2, Subpart B of Title 40 of the Code of Federal Regulations. For any portion of the information sub- mitted which is entitled to confidential treatment, a confiden- tiality claim may be asserted in accordance with 40 C.F.R. Sec- tion 2.203. If such a claim is asserted the information will be disclosed only to the extent, and by means of the procedures specified in 40 C.F.R. Part 2, Subpart B. EPA will construe the failure to furnish a confidentiality claim with response to this letter as a waiver of that claim, and information may be made available to the public by EPA without further notice.
