BEFORE THE BOARD OF DIRECTORS OF THE <br />MOUNTAIN HOUSE COMMUNITY SERVICES DISTRICT <br />RESOLUTION <br />No. 2020-38 <br />RESOLUTION OF THE MOUNTAIN HOUSE COMMUNITY SERVICES DISTRICT <br />TO SUBMIT AN APPLICATION TO THE SAN JOAQUIN LOCAL AGENCY <br />FORMATION COMMISSION FOR THE ANNEXATION OF CERTAIN SPECIFIC <br />PLAN AREA I LANDS LOCATED NORTH OF BYRON ROAD <br />WHEREAS, the Mountain House Community Services District ("District") was formed <br />on May 20, 1996, to provide capital improvements and public services to the Mountain House <br />Community; and <br />WHEREAS, the San Joaquin County issued a Notice of Intent to Adopt a Mitigated <br />Negative Declaration for the proposed Project on July 31, 2020; and <br />WHEREAS, the Developer desires to annex land identified in Exhibit A ("Annexing <br />Property") into the District; and <br />WHEREAS, the Annexing Property is consistent with Specific Plan I, as well as the <br />District's most recent Sphere of Influence and Municipal Service Review, approved by the San <br />Joaquin Local Agency Formation Commission ("LAFCo") on January 12, 2017; and <br />NOW, THEREFORE, BE IT RESOLVED that, pursuant to Title 14 of the California <br />Code of Regulations section 15096 this Board of Directors has received and considered the <br />Mitigated Negative Declaration and finds as follows: <br />The conditions set forth in Title 14 of the California Code of Regulations section 15162, <br />15163, and 15164 are not present. <br />The conditions giving rise to the preparation of additional environmental documents <br />tiered from a program EIR, as set forth in Title 14 of the California Code of Regulations <br />section 15168, are not present. <br />BE IT FURTHER RESOLVED that the District does hereby approve submission of an <br />application to the San Joaquin Local Agency Formation Commission for the annexation of the <br />Annexing Property as follows:
