PAYNE DEPUTY DIRECTOR RESOLUTION PROVIDING_ FOR THE ESTABLISHMENT OF STIPULATIONS FOR THE SOLID WASTE CLOSURE ENTERPRISE FUND, AND FOR THE ADDITION OF THE NORTH COUNTY SANITARY LANDFILL SUB -BUDGET UNIT TO THE THE SOLID WASTE CLOSURE ENTERPRISE FUND '— (ALL SUPERVISORIAL DISTRICTS) Dear Board Members: IT IS RECOMMENDED: That the Board of Supervisors adopt the Resolution titled "RESOLUTION PROVIDING FOR THE ESTABLISHMENT OF STIPULATIONS FOR THE SOLID WASTE CLOSURE ENTERPRISE FUND, AND FOR THE ADDITION OF THE NORTH COUNTY SANITARY LANDFILL SUB -BUDGET UNIT TO THE SOLID WASTE CLOSURE ENTERPRISE FUND." REASONS FOR RECOMMENDATION: Assembly Bill 2448 mandates, in part, that by January 1, 1989, landfill operators were to establish a trust fund, or equivalent financial mechanism, to ensure adequate financial resources for closure and postclosure maintenance activities for landfills in California. The County of San Joaquin, as operator of the Harney Lane Sanitary Landfill and in accordance with its contractual obliga- tions with Foothill Sanitary Landfill, elected to use an Enterprise Fund to comply with the mandates of Assembly Bill 2448. As a result, the Board of Supervisors, on December 6, 1988, passed and adopted Resolution R-88-1323, which provided for the establishment of the Solid Waste Closure Enterprise Fund (SWCEF). The SWCEF is the repository of funds earmarked for the exclusive use to fund closure and postclosure activities for the Harney Lane and Foothill Sanitary Landfills.
