GEORGE DEUWEJIAN, Govemor <br />CALIFORNIA WASTE MANAGEMENT BOARD y <br />1020 NINTH STREET, SUITE 300 <br />SACRAMENTO, CALIFORNIA 95814 ENVIRONMENTAL HEALTH <br />PERMIT/SERVICES <br />OCT 13 1989 <br />Ed Padilla <br />San Joaquin Local Health District <br />1601 East Hazelton Avenue <br />Stockton, CA 95201 <br />Subject: North County Sanitary Landfill, <br />Facility No. 39 -AA -0022 <br />Dear Mr. Padilla: <br />This letter is to confirm your conversation of October 2, 1989 <br />with Janet Page in which you were advised to reject the <br />application from Tom Horton, operator of the proposed North <br />County Landfill. <br />The California Waste Management Board requires that all other <br />permits be issued for a project prior to its consideration of a <br />Solid Waste Facilities Permit. These permits may include <br />Conditional Use Permit, Waste Discharge Requirements, Department <br />of Fish and Game, Corps of Engineers, etc. Because of the <br />lengthy timeframes involved in acquiring some of these permits, <br />lwe recommend to LEA's that a complete application for SWFP <br />Minclude these permits, although they are not required. If these <br />other permits are not issued by the time on LEA is required to <br />submit a proposed SWFP to the Board, difficulties arise <br />necessitating the waiving of timeframes and delays in the <br />submittal of the SWFP. It for this reason we advise LEA's to <br />require other permits up front. <br />We understand the Army Corps of Engineers (COE) needs to make a <br />determination whether or not it is necessary to issue a permit <br />under Section 404 of the Clean Water Act for the impacted <br />wetlands area on this site. The significance of the wetlands <br />area is addressed in the Report of Disposal Site Information <br />submitted to our office by EMCOM Associates. As stated in the <br />report, "Because more than 1 acre of jurisdictional wetland will <br />be affected, a predischarge notification is required for <br />submittal to the COE Sacramento branch. In addition to the <br />elimination of wetland the NCSL would eliminate at least six <br />vernal pools, two irrigation reservoirs, and three drainage pools <br />on South Paddy Creek. ...This impact is considered significant." <br />I would advise you to have the operator contact Tom Coe at the <br />Local Army Corps of Engineers office at (916) 551-2273 for <br />further direction. <br />
