OBSERVATION: The business plan information was not reviewed and resubmitted in the California Environmental Reporting System (CERS) annually by the due date, January 15. The annual submittal for not completed until January 22 for 2020. The business plan has not been resubmitted for 2018, 2019, 2020, and 2021. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a Class II violation. 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. OBSERVATION: Documentation showing initial and annual refresher training was not available. REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate notice, for the business site. This training shall be documented electronically or by hard copy and shall be made available for a minimum of three years. CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the training records to the EHD. This is a Class II violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by June 19, 2021. Assistance with CERS update and submittal provided at the time of inspection.
