CONDITIONS OF APPROVAL <br />PA-2100030 <br />CAMILLO LEVENTINI, ET AL. AND JOYCE SACO, ET AL./ BAUMBACH & PIAZZA <br />Minor Subdivision Application No. PA-2100030 was approved by the Community Development <br />Department on September 13, 2021. The effective date of approval is September 23, 2021. This tentative <br />map approval will expire on September 22, 2024, which is three (3) years from the effective date of <br />approval, unless (1) all Conditions of Approval have been complied with and (2) a Certificate of <br />Compliance has been filed with and accepted by the County Surveyor. <br />Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br />prior to approval of the Certificate of Compliance. Those Conditions followed by a Section Number <br />have been identified as ordinance requirements pertinent to this application. Ordinance requirements <br />cannot be modified and other ordinance requirements may apply. <br />1.COMMUNITY DEVELOPMENT DEPARTMENT (Contact: [209] 468-3121) <br />a.CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels. The property <br />descriptions submitted with the Certificate of Compliance application shall substantially conform with <br />the approved, revised tentative map dated August 11, 2021. A fee is required to process the Certificate <br />of Compliance application. (Development Title Section 9-890.4) <br />b.RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note shall <br />be recorded as a Notice of Minor Subdivision Restriction with the Certificate of Compliance: <br />1.All persons purchasing parcels within the boundaries of this approved map should be prepared to <br />accept the inconveniences or discomforts associated with agricultural operations or activities, such <br />as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br />inconveniencies or discomforts shall not be considered to be a nuisance. <br />c.LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this Minor <br />Subdivision: <br />1.All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br />(Development Title Section 9-610.4) <br />2.All parcels shall have a minimum lot area of 40 acres. (Development Title 9-610.2) <br />d.ACCESS: The following access requirements apply and shall be included in the Certificate of <br />Compliance property description: <br />1.A proposed 25-foot wide private easement for access to Parcel B, that extends a minimum of <br />2,531 feet from E. Jahant Road along the eastern boundary of Parcel A, shall be included in the <br />property description for the Certificate of Compliance. (Development Title Section 9-1150.15) <br />2.A proposed 25-foot wide private easement for access to Parcel C, that extends a minimum of <br />1,334 feet from E. Jahant Road along the western boundary of Parcel D, shall be included in the <br />property description for the Certificate of Compliance. (Development Title Section 9-1150.15) <br />3.The following note shall be included in the Certificate of Compliance and also shall be recorded <br />as a separate instrument: <br />A.At the time of non-agricultural development of Parcels B or C, the entire length of the private <br />right-of-way for Parcel B or C, shall be constructed and maintained to the standards required <br />by the California Fire Code and applicable San Joaquin County Improvement Standards. <br />PA-2100030 -Conditions of Approval
