J OA Q U I N Environmental Health Department <br /> —COUNTY— <br /> WASTE DISCHARGE/SPILL RESPONSE <br /> NOTICE TO ABATE <br /> Responsible Party: SAN JOAQUIN COUNTY Date: May 04,2021 <br /> RP Mailing Address: 444 S WILSON WAY Record ID#: COH5TLEBZ <br /> STOCKTON, CA 95205- Program Element: 2546 <br /> Spill Location: 2101 E EARHART AVE, STOCKTON Release/Spill Response(excluding Joint Team) <br /> NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br /> Approximately 5-10 gallons of diesel was released while a contractor was filling up an aboveground storage tank. Fuel <br /> spilled onto asphalt and into an oil-water separator. <br /> OBSERVATIONS: <br /> Met with Lowell Allen, emergency planner for the San Joaquin County Office of Emergency Services. Several patches of <br /> dark staining were observed around the fuel station. The fuel contractor, Stockton Petroleum, used absorbent to contain <br /> and clean up the spill on the asphalt. Per Lori Toccoli, president of Stockton Petroleum,the absorbent was taken back to <br /> the Stockton Petroleum service yard for storage as hazardous waste until it can be transported to the San Joaquin County <br /> Household Hazardous Waste facility for disposal. Lori said that the spill occurred because of a broken clock gauge on the <br /> tank. Lori estimated that 2 quarts of diesel was released based on how much fuel was left in the truck. <br /> Absorbent and staining was observed around the oil-water separator(OWS)drain in the middle of the fuel station. <br /> Saturated absorbent was observed in the OWS drain. <br /> Per California Health and Safety Code 25160(b)(3), the disposal of any hazardous waste, or the causing thereof, <br /> isprohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal. <br /> Immediately clean the OWS drain and examine the system/connected piping to ensure that no diesel flowed into the sewer <br /> line. Any diesel contamination must be cleaned up. <br /> VIOLATIONS: <br /> Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Immediately. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Submit final disposal records and hazardous waste determination documents to the EHD. <br /> EHD 25-01 Rev.9/16/2020 Page 1 of 2 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br /> 1868 E.
