CONDITIONS OF APPROVAL <br /> PA-2100122 <br /> DOUGLAS W. CARMEAN/❑IL.LON& MURPHY <br /> Minor Subdivision Application No. PA-2100122 was approved by the Community Development <br /> Department on August 6, 2021. The effective date of approval is August 16, 2021. This tentative map <br /> approval will expire on August 15, 2024, which is three (3) years from the effective date of approval, <br /> unless(1)all Conditions of Approval have been complied with and (2)a Certificate of Compliance has <br /> been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Certificate of Compliance. Those Conditions followed by a Section Number <br /> have been identified as ordinance requirements pertinent to this application. Ordinance requirements <br /> cannot be modified and other ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT{Contact Staff. (20,91468-3121) <br /> a. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels. The <br /> property descriptions submitted with the Certificate of Compliance application shall substantially <br /> conform with the approved tentative map dated June 14, 2021. A fee is required to process the <br /> Certificate of Compliance application. (Development Title Section 9-890.4) <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note shall <br /> be placed on the Final Map and recorded as a separate instrument: <br /> 1. Ali persons purchasing parcels within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities,such <br /> as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconversiencies or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this application <br /> 1. All parcels shall have a minim urn lot width of 330 feet, measured at the front yard setback line. <br /> {Development Title Section 9-610.4} <br /> 2. All parcels shall have a minimum lot area of 40 acres. {Development Title Section 9-610.2} <br /> d ACCESS: The following requirements apply and shall be described on the Certificate of Compliance: <br /> 1. A proposed 25-foot wide private easement for access to Parcel Two. along Parcel One, shall be <br /> described on the Certificate of Compliance. (Development Title Section 9-1150.15) <br /> 2. The following note shall be recorded as Notice of Minoi Subdivision Restriction: <br /> A. At the time of non-agricultural development of Parcel Two, the entire length of the private right- <br /> of-way for Parcel Two shall be constructed and maintained to the standards required by the <br /> California Fire Code and applicable San Joaquin County Improvement Standards. <br /> tDevelopment Title Section 9-1150.15[c]) <br /> e. TREE PRESERVATION: Future development on the parcel(s) shall be consistent with the <br /> requirements of the County's Tree Preservation Ordinance (Development Title Section 9--1505.2)- <br /> The following note shall be shall be recorded as a separate instrument: <br /> 1. The removal of a Native Oak Tree, Heritage Oak Tree, or historical Tree shall require an approved <br /> Improvement Plan application.
