SANIOAQUIN <br /> Environmental Health Department <br />--COUNTY-- <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: FRANK C ALLEGRE TRUCKING INC <br /> Date: Feb 25, 2020 <br />RP Mailing Address: 5100W HVVY 12 <br /> Record ID#: C00051676 <br />LODI, CA 95242- Program Element: 2546 <br />Spill Location: 5100W H1NY 12 , LODI <br /> Release/Spill Response (excluding Joint Team) <br /> <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />Large amount of oily substance going into the storm drain. <br />OBSERVATIONS: <br />AMENDED ON 02-26-2020: During a site visit on 02-25-2020 met with Tony Allegre. Tony indicated the area of alleged oil <br />release is on rental property, and not part of Frank C Allegre Trucking, observed a large amount of what looks like <br />brownish-red oily liquid. The oily liquid traveled to the drain that leads to the on site retention pond. The retention pond did <br />not have any oily liquid leaking from the inlet. Facility applied absorbent pads and absorbent over the oily liquid to contain the <br />release. Based on SDS provided by the facility, the spilled liquid appears to be a combination of Magnesium Lignosulfonate <br />Solution, Intermediate, and Heavy (up to 58%) and Plaza 48% Solids Red Liquor, which exhibits aquatic toxicity <br />characteristic. The spill area as well as the strom drain line leading to the retention pond must be cleaned up as appropriate <br />by adequately trained personnel. Notify EHD in advance of clean up to facilitate clean up verification. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />LORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Provide hazardous waste determination and final disposal records. <br />1'1 Other Correction <br /> <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 08/17/17 Page 1 of 2 <br />1868 E.
