<br />to fifty percent (50%) of the gross price received by Grantee, its successors or assigns, for the sale, transfer,
<br />lease, exchange or other conveyance, in whole or in part, to a third party for use outside the Property, of any
<br />and all water rights (including all water in Oakwood Lake), whether riparian rights to surface water or the right
<br />to percolating ground water, associated with the Property, including without limitation, the sale, transfer,
<br />lease, exchange or other conveyance of said water rights for the purpose of providing in stream flows, as
<br />reserved by in the Deed by Vernalis Enterprises Inc., a Nevada corporation to Beck Properties, Inc., a
<br />California corporation recorded November 19, 2004 as Instrument No. 2004-265431 in Official Records, as
<br />their respective interest appears.
