No further action is required to correct this violation. <br /> This is a repeat violation, Class II. <br /> 117 HSC 25185(c)(3) Failed to submit a written response within 30 days of receiving an inspection report. <br /> OBSERVATION: This business did not provide a written response to the inspection report dated 1/26/2016 within 30 <br /> days. The report was delivered to the business on 1/26/2016. <br /> REGULATION GUIDANCE: The operator of the site or facility which receives an inspection report shall submit a <br /> written response to the department or the local officer or agency authorized to enforce this chapter pursuant to <br /> subdivision (a)of Section 25180 within 60 days of receipt of the inspection report, or within a shorter time as the <br /> department or the local officer or agency may reasonably require,which shall include a statement documenting <br /> corrective actions taken by the operator or proposing corrective actions which will be taken by the operator,for <br /> purposes of compliance with this chapter, or disputing the existence of the violation. The local agency,the San <br /> Joaquin County Environmental Health Department, requires response within 30 days. <br /> CORRECTIVE ACTION: The violation was corrected during the inspection by providing inspector with an email <br /> statement. No further action is required to correct this violation. <br /> This is a repeat violation, Class II. <br /> 403 CCR 66262.34(d)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> OBSERVATION: The following open hazardous waste storage containers were observed on-site: One white plastic <br /> 55 gallon drum of used oil was observed with an open bung in the hazardous waste storage area <br /> REGULATION GUIDANCE:A container holding hazardous waste shall always be closed during transfer and <br /> storage, except when it is necessary to add or remove waste. <br /> CORRECTIVE ACTION: The violation was corrected during the inspection by closing the used oil drum.
